Terms & Conditions

for

BrianZweig.com

Effective Date: June 1, 2026

1. Acceptance and Scope

These Terms and Conditions ("Terms") govern access to and use of www.BrianZweig.com and related pages, online forms, and features (collectively, the "Website") operated by Friends of Brian Zweig ("Campaign," "we," "us," or "our") in connection with the campaign for North Greenbush Town Supervisor. By accessing or using the Website, you agree to these Terms to the extent permitted by applicable law. If you do not agree, do not use the Website. These Terms do not eliminate rights that cannot lawfully be waived.

2. Website Purpose and Political Content

The Website provides campaign information, statements of policy positions, event details, ways to volunteer and contact the Campaign, and, where enabled, political contribution opportunities. Content represents campaign views at the time published and may be updated, revised, or removed. The Website is not an official website of the Town of North Greenbush, Rensselaer County, or any government agency. Any references to public institutions or officials do not imply governmental sponsorship or endorsement.

3. Eligibility and Permitted Use

You may browse publicly available Website content subject to these Terms. When submitting information, registering for an event, volunteering, making a donation, or subscribing to messages, you must provide accurate information and meet any eligibility requirements associated with that activity. You agree not to impersonate others, interfere with the Website, probe its security, deploy malware, harvest personal information, or use the Website for illegal, deceptive, harassing, threatening, or infringing purposes. We may restrict abusive access where lawful.

4. Political Contributions and Payment Processing

Where the Website enables donations, all contributions are subject to applicable New York State election and campaign finance laws and relevant contribution limits, eligibility restrictions, disclosure requirements, and reporting obligations. Applicable limits may depend on the election and contributor category; the Campaign will not represent a fixed dollar limit in these Terms. Contributors must provide accurate identifying and other legally required information. Contributions may be processed by an independent payment processor, whose separate terms and privacy practices may apply. Submission of a payment does not guarantee acceptance: the Campaign may review, decline, refund, or return contributions as required or permitted by law. Processing fees and refund availability may depend on the processor and law. Contributions to political campaigns generally are not tax-deductible as charitable contributions. No goods, services, preferential access, or governmental action are promised in exchange for a contribution. The Campaign will make legally required campaign-finance disclosures, which may become public.

5. Fundraising Disclosures and Paid-for Notices

Required political advertising, committee identification, and "paid for by" notices must appear where and in the form required by applicable law. Any footer or solicitation disclaimer should identify the actual legally registered committee, not an assumed committee name. Nothing in these Terms substitutes for disclosures required on donation pages, advertisements, emails, printed material, or other communications.

6. Volunteer, Event, and Other Form Submissions

When you submit a form or express interest in volunteering, hosting events, displaying signs, canvassing, contacting voters, or assisting the Campaign, you authorize us to use the information submitted to address that request and coordinate campaign activities as described in our Privacy Policy. Submission does not create employment, an agency relationship, compensation entitlement, or a guarantee of participation. We may set reasonable event rules and decline or terminate participation for safety, disruption, or legal-compliance reasons. Event details, capacity, dates, or venues may change.

7. Email Communications

If you opt in to campaign email updates, you may unsubscribe using the link included in applicable email messages or by contacting us at [email protected]. Transactional messages, such as confirmations related to a request you initiated, may be handled separately as permitted by law. Website use alone does not mean you have opted in to recurring marketing or campaign email messages.

8. Text Messages and Mobile Messaging

Where offered, campaign SMS enrollment is optional and requires the consent appropriate to the messages and technology used. Consent to receive text messages is not a condition of making a contribution, volunteering, or obtaining campaign information. Message frequency may vary. Message and data rates may apply. Reply STOP to unsubscribe and HELP for assistance, where supported, or contact [email protected]. Opt-out requests will be honored as required by applicable law. Do not rely on text messaging for emergencies. The Campaign's Privacy Policy addresses collection, handling, and sharing of mobile opt-in data. Text messaging opt-in data, consent and related collected personal information will not be shared with or sold to any third parties, unless required by law. Any technical processing by messaging vendors must be accurately reflected in the Privacy Policy and must be reviewed for consistency with this commitment before publication. These Terms do not themselves constitute consent to be texted.

9. User Submissions, Photos, and Testimonials

If you send the Campaign comments, stories, photographs, endorsements, testimonials, suggestions, or other material ("Submissions"), you represent that you have the right to submit the material and that it does not violate others' rights or applicable law. Unless an upload form or separate release expressly states otherwise, sending a Submission does not automatically give the Campaign permission to publicly publish your name, likeness, photograph, or testimonial. Public use of identifiable personal stories or images will be governed by a separate consent or release where appropriate. For non-confidential campaign suggestions that you authorize us to use, you grant the Campaign a non-exclusive, royalty-free permission to review and use those suggestions for lawful campaign purposes, subject to applicable privacy rights. Do not submit sensitive personal information through unsecured general-purpose forms.

10. Comments and Moderation

If the Website enables public comments, forums, or other interactive features, we may moderate or remove content that is unlawful, threatening, discriminatory, defamatory, spam, privacy-invasive, misleading as to identity, or otherwise inconsistent with posted participation rules. Moderation decisions do not imply endorsement of remaining content. The Campaign is not obligated to host public comments or provide a public forum. Any forum rules will be applied subject to applicable law.

11. Intellectual Property and Limited License

Unless otherwise indicated, text, graphics, branding, original photographs, layouts, and other Campaign-created Website content are owned by the Campaign or used with permission and protected by applicable intellectual-property law. You may view, print, or share publicly accessible pages for lawful personal, informational, and noncommercial purposes, provided notices and attribution are preserved. You may not falsely claim Campaign endorsement, remove ownership notices, sell or commercially exploit Website content, or reuse third-party content without permission. Quotations, commentary, news reporting, and other lawful uses remain subject to applicable law, including fair use.

12. Third-Party Websites, Platforms, and Services

Links to social media, fundraising processors, event registration providers, map services, video platforms, and other external resources are offered for convenience. Those services may have their own terms and privacy practices. We do not control independent websites, and linking does not necessarily imply endorsement. Transactions or disputes involving a third-party provider may also be governed by that provider's terms.

13. Privacy, Cookies, and Data Handling

Your use of the Website is also governed by our separately posted Privacy Policy at BrianZweig.com/admin/privacy-policy. The Privacy Policy should describe categories of information collected; cookies and analytics; purposes of use; service-provider processing; campaign-finance reporting; retention; security; and available privacy choices. If these Terms and the Privacy Policy conflict on treatment of personal data, the more specific Privacy Policy governs to the extent permitted by law. Please contact the Campaign about privacy questions using the information below.

14. Information Accuracy and Election Resources

We seek to provide accurate information, but campaign positions, endorsements, schedules, polling-place details, registration rules, voting methods, and deadlines can change. Do not treat Website material as official election administration advice. Verify voter-registration, early-voting, polling-place, absentee-voting, and election-date information with the Rensselaer County Board of Elections or New York State Board of Elections. The Campaign is not responsible for government agency changes or third-party inaccuracies.

15. Accessibility

We aim to make the Website reasonably accessible and welcome accessibility feedback. If you encounter a barrier to accessing information or completing a form, contact [email protected] and identify the page and difficulty. We will make reasonable efforts to provide information through an alternative method. This statement is an operational commitment and not a representation that every page meets a particular technical certification.

16. Security and Website Availability

We use reasonable operational safeguards appropriate to the services we provide, but no website, payment system, or electronic communication can be guaranteed completely secure or uninterrupted. Do not send passwords, Social Security numbers, or payment-card details in ordinary contact messages. We may suspend or modify parts of the Website for maintenance, security, legal compliance, or campaign needs without guaranteeing continuous availability.

17. Disclaimers

To the extent permitted by law, the Website and its content are provided on an "as is" and "as available" basis without warranties of uninterrupted availability, fitness for a particular purpose, or freedom from errors. Nothing in this section limits non-waivable consumer rights, liability that cannot lawfully be excluded, or any specific representations expressly required by law.

18. Limitation of Liability

To the extent permitted by applicable law, the Campaign and persons working on its behalf are not liable for indirect, incidental, consequential, special, or punitive damages arising from use of, inability to use, or reliance on the Website. This limitation does not apply to liability that cannot lawfully be limited, including liability for intentional misconduct where exclusion is prohibited. Nothing in these Terms deprives you of remedies provided by applicable law.

19. Indemnification

To the extent permitted by law, you agree to be responsible for third-party claims and reasonable costs arising directly from your unlawful use of the Website, your material violation of these Terms, or material you submit in violation of another person's rights. This provision does not require you to indemnify the Campaign for its own negligence, unlawful acts, or misconduct, or for any responsibility that applicable law does not permit shifting.

20. Changes to the Website and These Terms

We may revise these Terms as the Website, campaign activities, or legal requirements change. The "Last Updated" date identifies the current posted version. Revisions will apply prospectively from posting unless applicable law requires a different notice or consent procedure. Material changes affecting existing subscriptions or personal information will be handled consistently with applicable law and our Privacy Policy.

21. Governing Law and Disputes

These Terms are interpreted under the laws of the State of New York, without disregarding applicable federal law or mandatory protections. Any dispute concerning these Terms will be handled in a court with lawful jurisdiction and venue, subject to applicable procedural and jurisdictional rules. No mandatory arbitration or class-action waiver is imposed by these Terms.

22. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions continue to apply to the extent legally possible. These Terms, together with referenced policies and any separate terms expressly presented for a particular feature, govern Website use. A failure to enforce one provision does not automatically waive that provision.
